Eric Haley Music ("we," "us," "Eric") offers a monthly membership that gives you ongoing access to Eric as your producer, plus access to a community of fellow artists (collectively, the "Membership").
The Membership is access-based, not project-based. Your monthly payment secures your place as an active member and a standing relationship with Eric as your producer — it does not guarantee a specific number of songs, mixes, or finished deliverables in any given month. Some months you may finish a song. Other months you may be a few months into a single song, and that's expected and fine. The value of the Membership is that you always have a producer and a community, on a schedule that matches how you actually create — not a per-song countdown.
You own everything, by default. Unless we've separately agreed in writing otherwise, all recordings, stems, mixes, masters, and other production work Eric creates or delivers to you as part of your Membership are yours — including the master recording copyright. To the extent Eric's production and engineering contributions could otherwise be treated as jointly owned, Eric assigns and transfers that interest to you upon delivery, provided your Membership is active and in good standing at the time.
Songwriting is the one exception. If Eric contributes to writing a song — lyrics, melody, top-line, or other compositional elements — rather than just producing/engineering it, that creates a separate songwriting contribution. In that case, Eric's ownership share and/or writer credit for that specific song will be agreed between you in writing (e.g. a simple split sheet) before or shortly after the session. Absent that kind of co-writing contribution, this section doesn't apply and you own the composition as well as the recording.
Eric may be credited as producer/engineer on released work, consistent with standard industry practice, unless you request otherwise.
If your subscription is cancelled for non-payment or a reversed charge, we reserve the right to withhold final delivery of in-progress work until the account is brought current.
Members get access to a shared community space with other artists. To keep it useful for everyone:
You may cancel anytime as described in Section 2. We may suspend or terminate your Membership for non-payment, abusive conduct toward Eric or other members, or violation of these Terms. If we terminate for reasons other than your conduct or non-payment, we'll refund any prepaid, unused portion of your current billing period.
The Membership is provided "as is." To the fullest extent permitted by law, Eric Haley Music isn't liable for indirect, incidental, or consequential damages arising from the Membership, and our total liability for any claim is limited to the amount you paid in the three (3) months before the claim arose.
We may update these Terms from time to time. If we make material changes, we'll notify you by email or by posting a notice on the site before they take effect. Continuing your Membership after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Texas, unless we agree otherwise in writing.
